RESOLUTION OF INDUSTRIAL DISPUTE

There has been a successful meeting between Xstrata and the National Union of Mineworkers in regard to the industrial dispute at Xstrata's Thornecliffe mine. The Company has agreed to re-employ all 369 employees who were dismissed, on the basis that it reserves the right to discipline those employees who were involved in acts of violence.

In addition, the Company and the National Union of Mineworkers have reaffirmed their commitment to relationship building. Their respective representatives will meet early in the New Year to discuss the issues which led to the industrial action.

Daniel Sauter, CEO of Xstrata AG said "We are pleased that an amicable solution has been achieved with our workers within a short timeframe. It is reflective of our Company's attitude towards its own people and our desire to build our record of sound industrial relations".
